Fish issue at the small lake at the Beach Club

The Association is aware of the fish issue at the small lake at the Beach Club. The water quality was oxygen deficient. Contractors have been working on this issue since Tuesday night and oxygen has been added to the water.

CLMA Board Vacancy

Election for Board of Director Position for

Cinco Landscape Maintenance Association, Inc.

The Cinco Landscape Maintenance Association has two vacant positions on its Board of Directors to be filled by an election.  This term expires on June 2, 2015.  Meetings are held the first Tuesday of each month at the Cinco Association Office at 9:00 AM. The Annual Meeting will be held June 5, 2012. If you are interested in being considered for this position, please submit your letter of interest and a brief biography to the Association Office - Attention:  Jason Blackman.

Upcoming Cinco Ranch Election

Election for Two Residential Board of Director Positions for Cinco Ranch

The election for two Board of Directors positions will be held on May 21, 2012. These positions will both run June 1, 2012-May 31, 2015. The election for these positions will be held by the Neighborhood Representative Committee. Votes will be cast by the Voting Representatives, or their alternates, of each Cinco Ranch (Cinco I) Neighborhood. Any owner who has sufficient time to attend evening Board meetings twice a month, able to fully participate in the workings of the Board and is interested in running should submit a letter of intent and biography to Jason Blackman by mail or in person to 3022 Windemere Park Lane, Katy, Texas 77494, by email to jblackman@stes.com.

Pool Keys

Avoid the rush! Get your pool keys now!

Pool keys are $25.00 each. We accept checks and money orders. Each household can purchase up to three keys. Please bring your picture ID. If you are a new owner please bring the first page of your Settlement Statement. If the previous owner provided you with their pool keys, please bring them to our office so that we can exchange them for new keys free of charge. If you are a renter we must have a copy of your current lease and a letter from your landlord stating you are in good standing with them.

Katy ISD School Board Election

The Katy ISD School Board Election will take place on May 12, 2012 from 7:00 a.m. to 7:00 p.m. Early voting by personal appearance will be conducted each weekday between the hours of 7:00 a.m. and 6:00 p.m. beginning April 30, 2012 and ending May 8, 2012. A special Saturday early voting by personal appearance will also be held on Saturday, May 5, 2012 from 7:00 a.m. to 6:00 p.m.

2011 Texas Legislative Changes to the Foreclosure Process

During the legislative session in 2011, the State of Texas made a series of changes to the process in which Cinco Residential Property Association, Inc. may foreclose on a owner for lack of payment of assessment.  These changes lengthened the process by a number of weeks, and as a result added steps that by default, add additional costs to the process.  It could be argued that the legislature, while trying to assist property owners of Associations with allowing them more time, has made the process more costly to the owner.

In the past, the following steps took place before a property could be sold at foreclosure:  1.  HOA sends a demand letter to owner giving a 30 day period to pay the past due assessment.  2.  Foreclosure letter and posting of Notice of Sale then is filed and sent.  3.  This process takes place approximately 3 weeks prior to the actual foreclosure sale.  4.  After this 21 day period, the HOA may either "pass" the sale if payment(s) are received or follow through with the sale.  The entire process takes approximately 51 days and costs the HOA which in turn is billed to the property owner approximately $500 - $700.

Now the following takes place:  1.  HOA sends a demand letter to owner giving a 30 day period to pay the past due assessment.  2.  HOA attorney files a Application of Foreclosure with the County Court and the property owner has 38 days to respond.  3.  HOA attorney files a Motion of Entry with the County Court and Court has approximately 20 days to accept motion, along the same time property owner may make payment.  4.  County Court signs the Order to Proceed with Foreclosure after this 20 period is over.  5.  Foreclosure process begins with a 21 day period before foreclosure sale.  6.  After this 21 day period, the HOA may either "pass" the sale if payment(s) are received or follow through with the sale.  The entire process takes approximately 99 days and costs the HOA which in turn is billed to the property owner approximately $1200 - $1700.

As you can see, the allowance of time of approximately 7 weeks allows the property owner time to pay, but also ends up costing the Association quite a bit more, and in turn, the property owner.
